§ 28-5. Abatement, notice.

  • (a)

    Except as provided in subsection (c) of this section, when the police chief or any police officer becomes aware of the existence of any nuisance, he shall cause a written notice to be served upon the owner or occupant either in person or by the United States mail or by posting such notice on the premises. The notice shall give the owner or occupant seven days in which to abate the nuisance, except if the owner or occupant has previously, during the same calendar year, been given a notice pursuant to this section, then the notice shall give the owner or occupant 48 hours in which to abate the nuisance.

    (b)

    Subsection (a) of this section does not apply to nuisances for which another abatement procedure is provided by ordinance.

    (c)

    When the police chief or any police officer becomes aware of the existence of a nuisance described in section 28-3(14), he shall cause a written notice to be served upon the owner or occupant either in person or by the United States mail or by posting such notice on the premises. The notice shall give the owner or occupant seven days in which to abate the nuisance, except if the owner or occupant has previously, during the same calendar year, been given a notice pursuant to this section, then no notice shall be given.
