§ 2-397. Justification of award.

(a)

All bids in excess of $7,500.00 shall be accepted or rejected by the board of aldermen. When the award is not given to the lowest bidder, a full and complete statement of the reasons for placing the order elsewhere shall be entered upon the minutes of the board of aldermen.

(b)

If all bids received or the lowest bids received are for the same total amount or unit price, or the local bid is within five percent of the lowest bid, quality and service being equal, the contract shall be awarded to a local bidder who maintains an office/residence within the city or to a bidder who maintains an office/residence within the county if no local bid has been received.

(c)

The contract shall be awarded by the board of aldermen, at their discretion.
